| (1) यह नियमावली उत्तर प्रदेश आबकारी (विदेशी मदिरा के प्रीमियम फुटकर विक्रय के लाइसेंसों का व्यवस्थापन) नियमावली, 2020 कही जायेगी। | (1) These rules may be called the Uttar Pradesh Excise (Settlement of Licenses for Premium Retail Vends of Foreign Liquor) Rules, 2020. |

| (1) जब तक विषय या संदर्भ से कोई बात प्रतिकूल न हो, इस नियमावली में:- | (1) In these rules, unless there is anything repugnant in the subject or context,- |
| (क) “अधिनियम” का तात्पर्य समय-समय पर यथा संशोधित संयुक्त प्रान्त आबकारी अधिनियम, 1910 से है; | (a) “Act” means the United Provinces Excise Act, 1910 as amended from time to time; |
| (ख) “आबकारी वर्ष” का तात्पर्य दिनांक 01 अप्रैल से प्रारम्भ होकर कैलेण्डर वर्ष के 31 मार्च तक चलने वाले वित्तीय वर्ष से है; | (b) “Excise Year” means the financial year commencing from 1st April and ending with 31st March of a calendar year; |
| (ग) “परिवार” का तात्पर्य इसमें सम्मिलित दम्पत्ति (पति-पत्नी), आश्रित पुत्र/पुत्रों, अविवाहित पुत्री/पुत्रियों और आश्रित माता-पिता से है; | (c) “Family” means and includes spouse (husband or wife), dependent son(s), unmarried daughter(s) and dependent parents; |
| (घ) “विदेशी मदिरा” का तात्पर्य निम्नलिखित से है जिसमें निम्नलिखित सम्मिलित है:- | (d) “Foreign liquor” means and includes the following:- |
| (एक) समुद्रपार विदेशी मदिरा:- बीयर और स्प्रिट, वाइन्स और लिकर्स जिन्हें भारत में मानव उपभोग के आशय से आयात किया गया हो और जिनपर ऐसे आयात के लिये सीमाशुल्क अधिनियम, 1962 के साथ पठित सीमाशुल्क टैरिफ अधिनियम, 1975 के अधीन शुल्क संदेय हो; | (i) Overseas Foreign Liquor: Beer and spirit, wines and liquors, which have been imported into India, are intended for human consumption, and are liable on such importation to duty under the Customs Tariff Act, 1975 read with the Customs Act, 1962; |
| (दो) भारत निर्मित विदेशी मदिरा (आई.एम.एफ.एल.): भारत में निर्मित स्प्रिट या मदिरा, जिसे सुगंध या रंग की दृष्टि से भारत में आयातित स्प्रिट या मदिरा के समान परिष्कृत किया गया हो और जिसमें माल्ट स्प्रिट, व्हिस्की, ब्रांडी, रम, जिन, वोडका व लिकर्स सम्मिलित हैं। इसमें भारत में निर्मित बीयर, पैक की हुई ड्राफ्ट बीयर, पोर्टर, साइडर, एल, वाइन एवं कम तीव्रता के मादक पेय (एल.ए.बी.) भी सम्मिलित हैं; | (ii) Indian Made Foreign Liquor (IMFL): Spirit or liquor made in India and sophisticated or coloured so as to resemble in flavour or colour, liquor imported into India and includes Malt spirit, Whisky, Brandy, Rum, Gin, Vodka and liqueurs. It also includes beer brewed in India, packed draught beer, porter, cider, ale, wine and low alcoholic beverages (LAB). |
| (ङ) “प्रपत्र” का तात्पर्य इस नियमावली के साथ संलग्न प्रपत्र से है; | (e) “Form” means a form appended to these rules; |
| (च) “सरकार” का तात्पर्य उत्तर प्रदेश राज्य सरकार से है; | (f) “Government” means the State Government of Uttar Pradesh; |
| (छ) “व्यक्ति” का तात्पर्य 21 वर्ष से अन्यून व्यक्ति से है, जो भारत का नागरिक हो; | (g) “Individual” means a person who is a citizen of India not below the age of twenty-one years; |
| (ज) “लाइसेंस” का तात्पर्य इस नियमावली के अधीन स्वीकृत लाइसेंस से है; | (h) “License” means license granted under these rules; |
| (झ) “लाइसेंस प्राधिकारी” का तात्पर्य जिला मजिस्ट्रेट/किसी राजस्व जिला के कलेक्टर से है; | (i) “Licensing Authority” means the District Magistrate/Collector of a revenue district; |
| (ञ) “लाइसेंस फीस” का तात्पर्य प्रीमियम फुटकर विक्रय में विदेशी मदिरा के फुटकर विक्रय के एकान्तिक विशेषाधिकार के लिए लाइसेंस स्वीकृत करने हेतु राज्य सरकार के परामर्श से, आबकारी आयुक्त द्वारा समय-समय पर किसी आबकारी वर्ष के लिए प्रतिफल फीस के रूप में वसूल की जाने वाली नियत धनराशि से है: परन्तु यह कि यदि ऐसा लाइसेंस आबकारी वर्ष प्रारंभ होने के पश्चात निर्गत किया जाता है, तो वर्ष की शेष अवधि के लिए लाइसेंस फीस का निर्धारण शेष त्रैमासों की संख्या के अनुसार किया जाएगा। | (j) “License fee” means a sum fixed as consideration fee for grant of the license for exclusive privilege of retail sale of foreign liquor in premium retail vend to be realized by the Excise Commissioner in consultation with the State Government from time to time for an excise year. Provided that if such license is issued after the beginning of the excise year then license fee for the remaining period of the year shall be determined in proportion to the remaining number of quarters of the excise year. |
| (ट) “मॉल” का तात्पर्य विभिन्न वस्तुओं की बिक्री हेतु बहु लाइसेंस रखने वाली एकल फर्म/कंपनी के स्वामित्व वाले किसी परिसर में स्थित न्यूनतम 10,000 वर्ग फुट प्लिंथ क्षेत्रफल वाले किसी बड़े भवन अथवा भवनों से है। इसमें शॉपिंग/वाणिज्यिक काम्प्लेक्स, डिपार्टमेंटल स्टोर्स, सुपर मार्केट या हाइब्रिड हाइपर मार्केट भी सम्मिलित हैं। | (k) “Mall” means a large business complex which contains a variety of walk-in store(s) housed in one large building or buildings (with interconnecting pathways, on same or different floors with common passage area for buyers/visitors including the atrium or foyer, having parking facility) with a minimum plinth area of 10,000 square feet, situated within a compound and is owned by a single firm/company having multiple licenses to sell various commodities. It includes shopping/commercial complexes, departmental stores, supermarkets or hybrid hypermarkets. |
| (ठ) “प्रतिभूति धनराशि” का तात्पर्य लाइसेंस फीस के एक चौथाई धनराशि के समतुल्य वह धनराशि है, जो सावधि जमा रसीद अथवा ई-पेमेंट के माध्यम से जमा की जाए और जो व्यतिक्रम की स्थिति में समपहृत की जा सके; | (l) “Security Amount” means the amount equal to one-fourth of the amount of license fee, to be deposited through Fixed Deposit Receipt (FDR)/Bank Guarantee pledged in favour of District Excise Officer, or through e-payment, and is liable to be forfeited in case of any default committed by the licensee; |
| (ड) “परिवहन अनुज्ञा पत्र” का तात्पर्य थोक लाइसेंस यथा FL-2, FL-2B एवं BIO-1 से विदेशी मदिरा के परिवहन हेतु जारी अनुज्ञापन से है; | (m) “Transport permit” means a permit issued for the transport of foreign liquor from the wholesale license such as FL-2, FL-2B, and BIO-1; |
| (ढ) “आस्वादन कक्ष” का तात्पर्य लाइसेंस परिसर के भीतर एक अलग स्थान, जहाँ क्रेता को वाइन के आस्वादन की सुविधा अनुज्ञेय हो, से है; | (n) “Tasting room” means a separate space within the license premises where facility of wine tasting is permissible to buyer; |
| (2) इस नियमावली में प्रयुक्त किन्तु अपरिभाषित शब्द और पदों के वही अर्थ होंगे जो अधिनियम में उनके लिए समनुदेशित हैं। | (2) Words and expressions used but not defined in these rules shall have the meanings respectively assigned to them in the Act. |
3. विदेशी मदिरा के प्रीमियम फुटकर बिक्री के लिये लाइसेंस

| माल में सील्ड बोतलों/पैकेटों में विदेशी मदिरा की फुटकर बिक्री हेतु प्रपत्र वि.म.4-ग में लाइसेंस, लाइसेंस प्राधिकारी द्वारा निम्नांकित शर्तों के अधीन प्रदान किये जायेंगेः | One or more licenses in Form F.L.-4C may be granted by the Licensing Authority for retail sale of Foreign Liquor in sealed bottles in Malls, subject to the following conditions: |
| (एक) यह कि विक्रय हेतु दुकान न्यूनतम 500 वर्ग फुट कार्पेट क्षेत्र में होगी और दुकानों में ग्राहकों हेतु प्रवेश करने तथा अपनी इच्छानुसार शेल्फ से ब्राण्ड चुनने की सुविधा प्रदान की जायेगी। | (i) That the vend shall have at least 500 sq. feet carpet area and provide customers the facility to walk into the shop and select his/her choice of brand from the shelves. |
| (दो) यह कि विक्रय हेतु दुकान अच्छी गुणवत्ता की फ्लोरिंग और सुसज्जित शेल्फ सहित वातानुकूलित होगी जिससे कि विभिन्न प्रकार के ब्राण्ड शेल्फ में व्यवस्थित ढंग से प्रदर्शित किये जा सकें। | (ii) That the vend shall be air-conditioned with good quality flooring and well-decorated shelves so that various brands are displayed in a systematic layout. |
| (तीन) यह कि विक्रय हेतु दुकान में मदिरा भण्डारण एवं प्रदर्शन हेतु पृथक-पृथक प्रांगण होंगे। | (iii) That the vend shall have separate enclosures for storage and display of liquor. |
| (चार) यह कि दुकान का लाइसेंसधारी केवल उन्हीं श्रेणियों की विदेशी मदिरा, जिसे आबकारी आयुक्त द्वारा यथास्थिति प्राधिकृत किया गया हो, की बिक्री सील्ड बोतलों / पैकेटों में व्यक्तियों को करेगा। | (iv) That the licensee of the vend shall sell only those categories of Foreign Liquor authorized by the Excise Commissioner, as the case may be, to individuals in sealed bottles/packs. |
| (पाँच) यह कि दुकान का लाइसेंसधारी व्यक्तियों को परिसर में उपभोग हेतु मदिरा की बिक्री नहीं करेगा। | (v) That the licensee of the vend shall not sell liquor to individuals for consumption “on” the premises. |
| (छः) यह कि दुकान का लाइसेंसधारी किसी अन्य लाइसेंसधारी को मदिरा की बिक्री नहीं करेगा। | (vi) That the licensee of the vend shall not sell liquor to any other licensee. |
| (सात) इस संबंध में ऐसी अन्य शर्तें, जिन्हें आबकारी आयुक्त अधिरोपित करना उचित समझें। | (vii) Such other conditions as the Excise Commissioner may deem fit to impose in this regard. |
| (आठ) यह कि दुकान का लाइसेंसधारी क्रेता को वाइन आस्वादन कक्ष की सुविधा प्रदान करेगा। | (viii) That the licensee of the vend may provide wine tasting room facility to the buyer. |
| (नौ) यह कि दुकान का लाइसेंसधारी, मदिरा उपभोग से संबंधित उपसाधन की बिक्री कर सकेगा। | (ix) That the licensee of the vend may sell accessories related to liquor consumption. |
4. लाइसेंस स्वीकृत हेतु अपात्र व्यक्ति

| निम्नलिखित व्यक्ति लाइसेंस स्वीकृत हेतु पात्र नहीं हैं- | The following persons are not eligible for grant of licenses:- |
| (क) 21 साल से कम आयु के व्यक्ति; | (a) Persons below the age of twenty-one years; |
| (ख) ऐसे व्यक्ति, जो अनुन्मोचित दिवालिया हैं या जो अधिनियम या स्वापक ओषधि एवं मनः प्रभावी पदार्थ अधिनियम, 1985 (केंद्रीय अधिनियम संख्या 61, सन 1985) के उपबंधों के अधीन अपराधों या गैर-जमानती अपराध में दोषी ठहराये गये हों; या अभ्यासिक अपराधी हों; | (b) Persons who are undischarged insolvents or who have been convicted of offences under the provisions of the Act or the Narcotic Drugs and Psychotropic Substances Act, 1985 (Central Act No. 61 of 1985), or convicted of non-bailable offences or habitual offenders; |
| (ग) ऐसे व्यक्ति, जो किसी लोक या राजकीय देयता के बकायेदार हैं; | (c) Persons who are in arrears of any public or government dues; |
| (घ) कोई मदिरा बोतल भराई लाइसेंस धारक या अल्कोहल उत्पादक या निर्माता; | (d) Holder of any liquor bottling license or producer/manufacturer of alcohol; |
| (ड) विदेशी मदिरा थोक विक्रय लाइसेंस धारक; | (e) Holder of any wholesale license of Foreign Liquor; |
| (च) बार काउंसिल से पंजीकृत कोई अधिवक्ता या चिकित्सक या कम्पनी सचिव या चार्टर्ड अकाउंटेंट; | (f) An advocate registered with Bar Council or a doctor or a company secretary or a chartered accountant; |
| (छ) कोई सरकारी कर्मचारी। | (g) A government servant. |

| लाइसेंस के लिये आवेदन करने हेतु केवल ऐसा व्यक्ति पात्र होगा, जो– | Only such persons shall be eligible to make an application for license who– |
| (क) भारत का नागरिक हो; | (a) is a citizen of India; |
| (ख) कम्पनी अधिनियम, 1956 के अधीन पंजीकृत कोई कम्पनी हो; | (b) is a company registered under the Companies Act, 1956; |
| (ग) कम्पनी अधिनियम, 2013 के अधीन स्थापित कोई कम्पनी हो; | (c) is a company established under the Companies Act, 2013; |
| (घ) भागीदारी अधिनियम, 1932 के अधीन पंजीकृत कोई भागीदार फर्म हो, जिसके भागीदार भारत के नागरिक हों; | (d) is a partnership firm registered under the Partnership Act, 1932, whose partners are residents of India; |
| (ङ) कोई पंजीकृत एकमात्र स्वामित्व वाली फर्म हो; | (e) is a registered sole proprietorship firm; |
| (च) कोई लिमिटेड लायबिलिटी भागीदारी फर्म हो; | (f) is a Limited Liability Partnership (LLP) firm; |
| (छ) सोसायटी रजिस्ट्रीकरण अधिनियम, 1860 के अधीन पंजीकृत कोई सोसाइटी हो; | (g) is a society registered under the Societies Registration Act, 1860; |
| (ज) व्यक्ति होने की दशा में 21 वर्ष की आयु से अधिक का हो। | (h) is above 21 years of age, if an individual. |

| कोई लाइसेंस तब तक स्वीकृत नहीं किया जायेगा, जब तक कि– | A license shall not be granted unless– |
| (क) आवेदक के पास माल में न्यूनतम 500 वर्गफुट कार्पेट क्षेत्र की दुकान का कब्जा न हो। यदि प्रस्तावित परिसर का उपयोग, संपत्ति और भवन के स्वामी से भिन्न किसी व्यक्ति अथवा संस्था द्वारा किया जा रहा हो, तब पट्टा या किराया करार पंजीकृत होगा; | (a) The applicant is in actual possession of a shop measuring at least 500 sq. feet carpet area in a mall. If the proposed premises are being utilized by an individual or institution other than the owner of the property and building, the lease or rental agreement shall be registered; |
| (ख) दुकान का परिसर राष्ट्रीय या राज्य राजमार्ग या इसकी सर्विस लेन के बाहरी किनारे से 500 मीटर की दूरी में न हो और परिसर राष्ट्रीय या राज्य राजमार्ग से दृष्टिगोचर या सीधे पहुँचा जा सकने योग्य न हो; | (b) The premises of the shop is not within a distance of 500 metres of the outer edge of the National or State highway or its service lane and is not visible or directly accessible from such National or State highway; |
| परन्तु 20,000 या इससे कम जनसंख्या वाले स्थानीय निकायों के क्षेत्रों में उक्त दूरी 220 मीटर होगी; | Provided that in areas under local bodies having a population of 20,000 or less, the minimum required distance shall be 220 metres; |
| परन्तु यह और कि उपरोक्त निर्बन्धन नगर पालिका क्षेत्रों की परिधि में आने वाले लाइसेंस प्राप्त प्रतिष्ठानों पर लागू नहीं होंगे। | Provided further that the above restriction shall not apply to the licensed establishments situated within the limits of Municipal areas. |
| परन्तु यह कि किसी माडल शॉप (एफ.एल.-4ए) एवं विदेशी मदिरा दुकान (एफ.एल.-5डी) की 200 मीटर की परिधि में कोई नवीन प्रीमियम फुटकर विक्रय का लाइसेंस स्वीकृत नहीं किया जायेगा। यह निर्बन्धन प्रीमियम फुटकर विक्रय के पूर्व स्वीकृत लाइसेंसों पर लागू नहीं होगा। | Provided also that no new license of premium retail vend shall be granted within 200 metres radius of any model shop (FL-4A) and foreign liquor shop (FL-5D). This restriction shall not be applicable to the previously granted licenses of premium retail vend. |
| (ग) दुकान का परिसर उत्तर प्रदेश आबकारी दुकानों की संख्या और स्थिति नियमावली, 1968 के नियम 5 के उपनियम (4) के उपबंधों के प्रतिकूल प्रतिबंधित दूरी के भीतर न हो; | (c) The premises of the shop is not within prohibited distance contrary to the provisions of sub-rule (4) of Rule 5 of the Uttar Pradesh Number and Location of Excise Shops Rules, 1968; |
| (घ) आवेदक के पास सक्षम प्राधिकारी द्वारा जारी खाद्य सुरक्षा और मानक अधिनियम, 2006 के अधीन लाइसेंस न हो; | (d) The applicant does not have a license under the Food Safety and Standards Act, 2006 issued by the competent authority; |
| (ङ) दुकान के परिसर हेतु सक्षम प्राधिकारी द्वारा जारी अग्नि सुरक्षा का विधिमान्य प्रमाण पत्र न हो। | (e) The premises of the shop does not have a valid certificate of fire security issued by the competent authority. |
7. लाइसेंस स्वीकृति हेतु आवेदन

| (1) लाइसेंस हेतु आवेदन, विहित प्रपत्र में निम्नलिखित दस्तावेजों सहित जिला आबकारी अधिकारी को प्रस्तुत किया जायेगा– | (1) An application for license shall be made to the District Excise Officer in the prescribed form along with the following documents– |
| (क) अप्रतिसंदेय आवेदन शुल्क; | (a) Non-refundable application fee; |
| (ख) परिसर के विधिक विधिमान्य कब्जा का प्रमाण, स्वामित्व/पट्टा/किरायेदारी दस्तावेज आदि; | (b) Proof of lawful possession of the premises, ownership/lease/rental documents etc; |
| (ग) प्रस्तावित दुकान को स्पष्ट रूप से दर्शाते हुए प्रस्तावित परिसर की अभिन्यास योजना; | (c) A layout plan of the proposed premises, clearly showing the proposed shop; |
| (घ) प्रतिभूति धनराशि; | (d) Security amount; |
| (ङ) दो वर्ष के आयकर/वैट/जीएसटी दस्तावेज; | (e) Two years Income Tax/VAT/GST documents; |
| (च) पैन कार्ड व आधार कार्ड की स्वप्रमाणित छायाप्रतियाँ; | (f) Self-attested copies of PAN card & Aadhaar card; |
| (छ) खाद्य सुरक्षा एवं मानक अधिनियम, 2006 के अधीन एफ.एस.एस.ए.आई. द्वारा जारी पंजीकरण प्रमाण-पत्र की प्रति; | (g) Copy of registration certificate issued by Food Safety and Standard Authority of India under Food Safety and Standards Act, 2006; |
| (ज) सम्बन्धित जिले के पुलिस आयुक्त या उसके नामांकित अधिकारी (एस.पी./एस.एस.पी.) द्वारा जारी चरित्र प्रमाण-पत्र; | (h) Character certificate issued by Commissioner of Police or an officer nominated by him not below the rank of Superintendent/Senior Superintendent of Police of the concerned district; |
| (झ) सक्षम प्राधिकारी द्वारा जारी ऋणशोधन क्षमता प्रमाण-पत्र। | (i) Solvency certificate issued by the competent authority. |
| (2) आवेदक, पब्लिक नोटरी द्वारा सत्यापित शपथ-पत्र प्रस्तुत करेगा कि– | (2) Applicant shall furnish an affidavit duly verified by public notary stating– |
| (क) वह परिसर का स्वामी अथवा पट्टेदार है या उसके पास विधिसम्मत पट्टा विलेख या सहमति पत्र है; | (a) That he is the owner or lessee of the premises or holds a valid lease deed or consent letter as per rules; |
| (ख) उसका व उसके परिवार का नैतिक चरित्र अच्छा है, कोई आपराधिक पृष्ठभूमि नहीं है और उस पर कोई संज्ञेय या गैर-जमानती अपराध नहीं है; | (b) That he and his family members possess good moral character, have no criminal background and have not been convicted of any cognizable or non-bailable offence |

| (ट) उसके पास पर्याप्त पार्किंग स्थान है, जिससे यातायात में कोई बाधा उत्पन्न नहीं होगी; अन्यथा लाइसेंस रद्द किया जाएगा; | (k) That he has proper parking space and will not cause traffic nuisance, otherwise the license shall be cancelled; |

| (1) जहाँ कोई व्यक्ति, जिसके पक्ष में लाइसेंस स्वीकृत किया गया हो, इस नियमावली के अधीन यथाविहित लाइसेंस शुल्क या प्रतिभूति धनराशि जमा नहीं करता है या स्वीकृति प्राप्त करने के निर्धारित अवधि के भीतर प्रस्तावित दुकान का वास्तविक कब्जा नहीं प्राप्त करता है, वहाँ लाइसेंस प्राधिकारी लाइसेंस को रद्द कर सकता है और उसके द्वारा जमा लाइसेंस फीस और प्रतिभूति धनराशि को समपहृत कर लेगा। | (1) Where a person in whose favour license has been sanctioned does not deposit the license fee or security amount as prescribed under these rules or is not found in actual possession of the proposed shop within the stipulated period of the receipt of the sanction, the licensing authority may cancel the license and forfeit the license fee and security amount deposited by him. |

| (6) लाइसेंसधारी लाइसेंस प्राप्त परिसर से भिन्न किसी स्थान पर विदेशी मदिरा संचित नही करेगा। लाइसेंसधारी लाइसेंस प्राप्त परिसर के बाहर या उसके निकट अनधिकृत रुप में रखी गयी किसी विदेशी मदिरा के लिए उत्तरदायी होगा। | (6) The licensee shall not stock foreign liquor in any place other than the licensed premises. | (10)(क) सक्षम प्राधिकारी से अनापत्ति प्रमाण पत्र प्राप्त करने के पश्चात् हवाई अड्डों और मेट्रो स्टेशन /रेलवे स्टेशन के अंदर भी प्रीमियम फुटकर विक्रय अनुमन्य होगा । ऐसी दुकानों का प्रवेश एवं निकास द्वार मुख्य भवन के अंदर से होगा। | (10)(a) Premium retail vend shall also be allowed inside airports and metro stations/railway stations after getting No Objection Certificate from the competent authority. Entry and exit gates of such shops shall be from inside the main building. |
| (ख) प्रीमियम फुटकर विक्रय दुकानों पर पृथक कक्ष में केवल वाइन आस्वादन की सुविधा अनुमन्य होगी और आस्वादन कक्ष में विक्रय प्रतिबंधित होगा। | (b) Only wine tasting facility shall be allowed in a separate room at premium retail vend shops and sale in the tasting room shall be prohibited. |
| (ग) प्रीमियम फुटकर विक्रय दुकानों पर मदिरा सेवन संबंधी उपसाधन, जो आबकारी आयुक्त द्वारा अवधारित किया जाय, की बिक्री भी अनुमन्य होगी। | (c) Sale of liquor accessories, as may be determined by the Excise Commissioner, shall also be allowed at premium retail vend shops. |
| (घ) यदि लाइसेंसधारी किसी माह में कम से कम अपने मासिक न्यूनतम प्रत्याभूत राजस्व के समतुल्य मदिरा (विदेशी मदिरा, वाइन एवं कम तीव्रता के मादक पेय) का उठान करने में विफल रहता है तो उसे सम्बन्धित माह के बकाया राजस्व के समतुल्य अतिरिक्त प्रतिभूति 10 दिवसों के भीतर जमा करने की अपेक्षा की जायेगी, ऐसा न होने पर लाइसेंस स्वतः निरस्त हो जायेगा और बकाया राजस्व की नियमानुसार वसूली की प्रक्रिया आरम्भ की जायेगी। दुकान पर अविक्रीत स्टाक भी जब्त कर लिया जायेगा। | (d) If the licensee fails to lift liquor (foreign liquor, wine and low-strength alcoholic beverages) at least equivalent to monthly minimum guaranteed revenue in any month, he shall be required to deposit additional security equivalent to the outstanding revenue of the respective month within 10 days, failing which the license shall be automatically cancelled and the process of recovery of outstanding revenue will be initiated as per rules. The unsold stock at the shop shall also be seized. |

| (1) लाइसेंस प्राप्त परिसर में बिक्री के लिये दी गयी अथवा संचित की गयी विदेशी मदिरा घटिया, विकृत, नकली या अपमिश्रित नही होनी चाहिये और लाइसेंसधारी भारत निर्मित विदेशी मदिरा और विदेशी मदिरा के साथ किसी प्रकार की छेड़छाड़ नही करेगा जिससे उसकी गुणवता, तीव्रता, प्रकृति या मात्रा में कोई परिवर्तन आये। | (1) The foreign liquor offered for sale or stored in the licensed premises shall not be sub-standard, deteriorated, spurious or adulterated, and the licensee shall not tamper with the Indian Made Foreign Liquor and Foreign Liquor in any manner so as to alter their quality, strength, nature or quantity. |

| एक- लाइसेंसधारी, वि0म0-2, वि0म0-2ख, बी०आई०ओ०-1 लाइसेंस धारक अथवा आबकारी आयुक्त द्वारा प्राधिकृत किसी लाइसेंसधारी से विदेशी मदिरा की आपूर्ति, समय-समय पर उदग्रहणीय समस्त करों, प्रतिफल फीस, उपकर आदि को सम्मिलित करते हुए मदिरा के मूल्य का पूर्ण भुगतान करने के पश्चात् प्राप्त करेगा। उत्तर प्रदेश में स्थापित आयातक इकाइयों में समुद्रपार विदेशी मदिरा के किसी प्रकार के ब्राण्डों की अनुपलब्धता की स्थिति में प्राधिकृत व्यक्तियों द्वारा आबकारी आयुक्त की विशेष अनुमति के अधीन इन ब्राण्डों को अन्य राज्यों या संघ राज्यों में स्थापित कस्टम बाण्डों से उत्तर प्रदेश में समुद्रपार की विदेशी मदिरा का आयात नियमावली, 2003 के उपबंधों के अधीन खरीद सकता है। | i. The licensee shall affix conspicuous signboard at the entrance to the premium retail vend in the form/size approved by the Excise Commissioner bearing the name of the licensee, designation, location of premium retail vend, period of license, opening and closing time of vend and such other information as prescribed by Licensing Authority in bold letters. |

| चौदह-लाइसेंसधारी अपने लाइसेंसप्राप्त परिसर में कोई भी आसव, कैरामल, रंग, सुगंधि, सुरक्षा कोड, लेबुल, कैप्सूल, मुहर या कोई हानिकारक सामग्री नहीं रखेगा। | xiv. The licensee shall not keep in his licensed premises any spirit, caramel, colour, essence, security code, labels, capsules, seals or any other noxious material. |

| सोलह-लाइसेंसप्राप्त परिसर, 14 अप्रैल (अम्बेदकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गाँधी जयन्ती), 26 जनवरी (गणतन्त्र दिवस) और तीन ऐसे अतिरिक्त दिनों जैसा कि लाइसेंस प्राधिकारी द्वारा बन्दी के लिए अधिसूचित किया जाय, को छोड़कर बिक्री के लिए सभी दिवसों में पूर्वान्ह 10 बजे से रात्रि 10 बजे तक खुला रहेगा। लाइसेंस प्राधिकारी सुसंगत विधियों के उपबन्धों के अधीन कानून और व्यवस्था या सामान्य निर्वाचन से सम्बन्धित क्रिया कलापों आदि के कारण से भी दुकान की प्रीमियम फुटकर विक्रय की बन्दी के आदेश दे सकता है। उपरोक्त दिन/दिनों में प्रीमियम फुटकर विक्रय की बन्दी के लिए कोई प्रतिकर देय नहीं होगा। | xvi. The licensed premises shall remain open for sale on all days from 10.00 am to 10.00 pm except on 14th April (Ambedkar Jayanti), 15th August (Independence Day), 2nd October (Gandhi Jayanti), 26th January (Republic Day), and up to 03 more days as notified for closure by the Licensing Authority. The Licensing Authority may also order for closure of premium retail vend on account of law and order or general election related activity under the provisions of relevant laws. No compensation shall be given for the closure of premium retail vend on above dates/days. |
