Shri Manish Goel, learned Additional Advocate General, assisted by Shri Bipin Bihari Pandey, Shri B.K. Pandey and Shri Ravi Shankar Pandey, learned Additional Chief Standing Counsel, submits that now, vide Notification No. 4099/XLicense-59/Country Liquor/2025-26 dated 03.03.2025, the State Government has amended Rule 5 of the Uttar Pradesh Excise (Settlement of Licenses for Retail Sale of Country Liquor) Rules, 2002 and therefore, the instant writ petition has become infructuous.
Learned counsel for the petitioners does not dispute the aforesaid fact.
In view of above, the writ petition is dismissed at this stage as having become infructuous.
However, the dismissal of the writ petition will not preclude the petitioners from availing any legal remedy available to them under the law.
